1. Acceptance of Terms

By using the services of Precision Auto Works ("Company," "we," "our," or "us"), located at 847 King Street West, Toronto, ON M5V 1N8, you ("Customer," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and Precision Auto Works.

2. Services Provided

Precision Auto Works provides automotive repair, maintenance, diagnostic, and related services ("Services") for passenger vehicles, light trucks, and commercial vehicles. Services include but are not limited to:

• Engine diagnostics and repair
• Brake system service and repair
• Transmission service and repair
• Preventative maintenance
• Tire service and wheel alignment
• Electrical system diagnosis and repair
• Climate control service
• Suspension and steering service

We reserve the right to refuse service for any vehicle we deem unsafe to work on or beyond our capability to repair properly.

3. Estimates and Authorization

3.1 Written Estimates

Before performing any work exceeding $100 CAD, we will provide a written estimate that includes:

• Description of work to be performed
• Parts required and their estimated cost
• Labor charges
• Applicable taxes
• Estimated completion date

3.2 Customer Authorization

No work will be performed without your prior authorization. You may authorize work by:

• Signing a written estimate
• Providing verbal authorization (which we will document)
• Electronic authorization via email or our customer portal

3.3 Additional Work

If additional work is required beyond the original estimate, we will contact you for authorization before proceeding. If we cannot reach you, we will not perform additional work without your explicit consent, except for work necessary to make the vehicle safe to operate.

4. Payment Terms

4.1 Payment Due

Payment is due in full upon completion of services before the vehicle is released. We accept:

• Cash (Canadian dollars)
• Debit cards (Interac)
• Credit cards (Visa, Mastercard, American Express)
• Direct insurance billing (with pre-authorization)

4.2 Deposits

We may require a deposit of up to 50% for:

• Special order parts
• Extensive repairs exceeding $2,000
• Custom work or modifications

4.3 Late Payment

If payment is not received within 30 days of invoice date, we reserve the right to:

• Charge interest at a rate of 2% per month (26.8% annually)
• Exercise a mechanic's lien on the vehicle pursuant to Ontario's Repair and Storage Liens Act
• Pursue collection through legal means
• Charge reasonable collection costs and legal fees

5. Warranty

5.1 Parts and Labor Warranty

We warrant all parts and labor against defects for 24 months or 40,000 kilometers, whichever comes first, from the date of service. This warranty covers:

• Defects in parts supplied by us
• Workmanship errors in installation or repair
• Proper function of repaired systems

5.2 Warranty Limitations

Our warranty does NOT cover:

• Normal wear and tear
• Damage caused by accidents, misuse, or neglect
• Damage from failure to follow manufacturer's maintenance schedule
• Parts supplied by the customer
• Consequential or incidental damages
• Work performed by other shops
• Damage from environmental factors (rust, corrosion, road salt)

5.3 Warranty Claims

To make a warranty claim, you must:

• Return the vehicle to our facility
• Provide proof of the original service (invoice)
• Allow us to inspect the vehicle and diagnose the issue
• Not have had the work inspected or repaired by another facility

6. Vehicle Storage and Abandoned Vehicles

6.1 Storage

Vehicles must be picked up within 7 days of notification that work is complete. After 7 days, we may charge a daily storage fee of $25 CAD per day.

6.2 Abandoned Vehicles

If a vehicle is not picked up within 30 days of completion, and we have made reasonable efforts to contact you, the vehicle may be considered abandoned. We may exercise our rights under the Repair and Storage Liens Act, including selling the vehicle to recover costs.

7. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claim arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim
• We are not liable for any indirect, incidental, consequential, or special damages
• We are not liable for damages from delays in service or inability to use the vehicle
• We are not responsible for items left in vehicles unless we have issued a written receipt for such items

8. Customer Responsibilities

You agree to:

• Provide accurate information about your vehicle's condition and service history
• Disclose any known safety issues or recall notices
• Remove all personal items and valuables from the vehicle
• Maintain adequate insurance coverage on your vehicle
• Pick up your vehicle within 7 days of notification
• Follow all recommended maintenance and care instructions

9. Diagnostic Fees

Diagnostic fees are charged to identify problems with your vehicle. Diagnostic fees are typically $89.99-$149.99 depending on complexity. If you authorize the recommended repairs, diagnostic fees may be credited toward the total repair cost at our discretion.

10. Used, Reconditioned, and Aftermarket Parts

Unless you specifically request OEM (original equipment manufacturer) parts, we may use quality aftermarket, remanufactured, or used parts where appropriate. All parts meet or exceed industry standards and are covered by our warranty.

11. Environmental and Disposal Fees

We charge environmental fees for proper disposal of hazardous materials including oil, fluids, batteries, and tires. These fees are mandated by environmental regulations and are not negotiable.

12. Indemnification

You agree to indemnify and hold harmless Precision Auto Works, its owners, employees, and agents from any claims, damages, or expenses arising from:

• Your misrepresentation of vehicle condition or history
• Your failure to disclose known safety issues
• Your modification of completed work
• Your violation of these Terms and Conditions

13. Dispute Resolution

13.1 Informal Resolution

In the event of any dispute, we encourage you to first contact our management team to seek an informal resolution.

13.2 Mediation

If informal resolution is unsuccessful, both parties agree to attempt mediation through a mutually agreed upon mediator before pursuing litigation.

13.3 Governing Law

These Terms and Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal action must be brought in the courts of Ontario.

14. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

15. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect.

16. Amendments

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website or display in our facility. Your continued use of our services constitutes acceptance of modified terms.

17. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any written estimates or service agreements, constitute the entire agreement between you and Precision Auto Works regarding the services provided.
